Whistleblower

Pursuant to statutory provisions and common law public policy principles, California employers are prohibited from retaliating against employees who refuse to participate in perceived illegal activities or who report, or provide information concerning, alleged violations of state or federal laws, rules, or regulations of public importance. Employees may be protected from retaliation even when they complain directly to their employer and do not report the conduct to an outside public agency. Moreover, an employee does not necessarily need to prove that the conduct of the employer was in fact illegal, but must at least show that he or she had a reasonable or good faith suspicion that the employer’s conduct was illegal.

Examples of protected Whistleblower activities include:

  • Reporting wage and hour law violations, such as failing to pay minimum wage or overtime
  • Reporting health and safety violations, such as making a complaint to the Occupational Safety and Health Administration (OSHA)
  • Reporting violations of immigration laws
  • Reporting instances of tax evasion or embezzlement
  • Reporting instances of discrimination or harassment
