Sexual Harassment and Other Forms of Harassment

Employers have a duty to take all reasonable steps to prevent and remedy illegal harassment in the workplace, such as sexual harassment that creates a hostile work environment. Employees are protected from harassment that is related to a protected characteristic of the employee or protected characteristic of someone the employee is associated with. While sexual harassment may be the most common form of harassment that occurs in workplaces, California employees are protected against many other forms of harassment such as harassment on the basis race, religion, color, national origin, physical disability, mental disability, medical condition, genetic information, marital status, gender, gender identity, gender expression, age, sexual orientation, and military and veteran status.

In order to establish a claim for harassment, an employee must show that they were subjected to offensive comments (such as jokes, slurs, or derogatory comments) or other abusive conduct that was based on the employee’s protected characteristic or was based on the protected characteristic of someone the employee associated with. The employee must also establish that the conduct directed at the employee was sufficiently severe or pervasive to alter the conditions of their employment.
